Terms of service

Welcome to Gramicci’s online store (the “Site”). The Site is operated by LEPICERIE PTY LTD (“Gramicci,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, as well as any purchases made through it.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

We may update these Terms from time to time. Your continued use of the Site constitutes acceptance of any revised Terms.


1. Use of the Site

You must be at least 18 years old, or at least 13 years old and using the Site with the supervision of a parent or guardian.

We grant you a limited, non-exclusive, revocable licence to access and use the Site for personal, non-commercial purposes. You must not:

  • reproduce, distribute, modify, or create derivative works from the Site

  • use the Site for illegal, fraudulent, harmful, or commercial purposes

  • interfere with the security or functionality of the Site

  • upload or transmit harmful code (e.g., viruses, malware)

You are responsible for maintaining the confidentiality of your account details and for all activity conducted using your account. Notify us immediately of any unauthorised use.


2. Purchases

When you place an order on the Site, you are making an offer to purchase products from Gramicci. We reserve the right to accept or reject any order for any reason.

Prices are listed in AUD and may vary by region. We may update pricing at any time before an order is accepted. All purchases are processed through Shopify’s secure checkout.

Your payment provider may charge currency conversion or transaction fees if your bank account is not in AUD. These fees are not charged by Gramicci and are your responsibility.


3. Billing

Your billing statement will reference Gramicci or LEPICERIE PTY LTD as the merchant of record.

4. Shipping

We ship orders only within Australia and New Zealand.
Orders are fulfilled by third-party logistics partners engaged by Gramicci.

Shipping times provided at checkout are estimates only. We are not responsible for delays outside our control, including carrier delays or customs processing for NZ orders.

You must provide accurate shipping information. If parcels are returned to us due to incomplete, invalid, or refused delivery, we may refund the order minus shipping and return costs, or arrange reshipment at your expense.


5. Returns & Exchanges

Your rights under the Australian Consumer Law (ACL) apply in addition to our policy below.

To return or exchange an item, you must follow the instructions on our Returns & Exchanges page.

Unless otherwise required under ACL:

  • items must be returned in original condition (unused, unwashed, with tags)

  • return requests must be initiated within 14 days of receiving the item

  • returned items must be received by us within 30 days of purchase

  • original shipping fees are not refundable unless required by law

  • returns that do not meet the criteria may be rejected

If a return is rejected, you will be responsible for the cost of reshipment.

Where duties or taxes were included in the purchase price, they will be refunded; if paid directly to customs (e.g., NZ orders), refunds must be sought from the relevant authority.


6. Refund Processing

Once a return is accepted or an order is cancelled:

  • refunds are typically initiated within 1–2 business days

  • refunds are issued to the original payment method

  • your bank or card provider may take up to 10 business days to display the refund

Store credit (if offered) is issued within 1–2 business days and appears in your account shortly after.


7. Product Information

We aim to display products accurately, but colours may vary depending on your device. Product availability cannot be guaranteed.

We reserve the right to correct errors, including pricing errors. If the correct price is higher than the displayed price, we may contact you to confirm the order or cancel it and process a refund.


8. Account Conduct & Fair Use

We monitor account behaviour to maintain a fair shopping environment.
We may restrict or close accounts, or refuse future orders, where we identify:

  • repeated or abusive returns

  • fraudulent chargebacks

  • misuse of promotions

  • behaviour inconsistent with normal consumer use

If you believe we have acted in error, please contact customer support.


9. Intellectual Property

All content on the Site—including images, text, graphics, logos, icons, and software—is owned by Gramicci or its licensors and is protected by Australian and international copyright and trademark laws.

You may not use our trademarks or content without permission.


10. Customs, Duties & Taxes (NZ Orders)

For orders shipped to New Zealand:

  • duties, taxes, and import fees may apply

  • these charges are the responsibility of the recipient unless otherwise stated

  • refused deliveries due to customs charges will not be refunded for shipping or return fees

Please check NZ customs requirements before ordering.


11. Third-Party Links

The Site may contain links to third-party websites. These are provided for convenience only. We do not endorse, control, or guarantee the content or security of any third-party sites.


12. Termination

We may suspend or terminate your access to the Site at any time without notice. On termination, your right to use the Site immediately ceases.


13. Disclaimer & Limitation of Liability

To the fullest extent permitted by law:

  • the Site is provided “as is” and without warranties

  • we exclude all implied warranties except those that cannot be excluded under the ACL

  • we are not liable for indirect, incidental, or consequential losses

  • our total liability for any claim is limited to the amount you paid us for the product giving rise to the claim, unless otherwise required under the ACL

Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law.


14. Indemnity

You agree to indemnify and hold harmless Gramicci, its employees, and agents from claims or damages arising from your misuse of the Site or breach of these Terms.


15. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.
You submit to the exclusive jurisdiction of the courts of New South Wales.
